Complaints and delay

When a claim is stuck: delay that is just slow, and delay that is defective

How to chase a live claim, when to ask for expedition, and when delay itself becomes a CDDA or Ombudsman issue.

DVA publishes processing timeframes. A claim sitting inside those timeframes is slow and infuriating; it is not, by itself, defective administration. A claim that has been flagged for expedition because of financial hardship or deteriorating mental health, and then left untouched for weeks with no substantive action, is a different animal. The file has to show the flag, the date, and the silence.

A chase sequence that does not make things worse

  1. 1Check MyService and any unopened letters. Many “delays” are a request sitting in the portal.
  2. 2One written follow-up to the allocated delegate or team, with the claim number, lodgement date, what you need decided, and a clear question: “What is the current status, what is outstanding from me, and when will it next be actioned?”
  3. 3If there is no meaningful reply in 10 business days, send the same letter marked as a second request and copy the team mailbox if you have one.
  4. 4If hardship or a mental health crisis is the reason it cannot wait, say so once, attach evidence (medical certificate, overdue bills, notice of eviction, child support), and ask in writing for expedition. Keep the tone factual.
  5. 5If still nothing, you have three parallel tracks: DVA complaint, Commonwealth Ombudsman, and (if the delay itself caused extra loss) a CDDA claim. They are not substitutes for each other.

Backlog versus failure to prioritise

DVA will often answer a delay complaint with “there is a backlog”. That may be true. It does not answer the second question: once this file was flagged as urgent, was it actually treated as urgent? Those are different investigations. If you go to the Ombudsman, ask both. Ask how many similarly flagged files were processed in that period, and who owned yours.

What delay is not

  • A medical report DVA is still waiting on from your specialist is not DVA delay. Chase the specialist too.
  • A PI claim that cannot start because liability is not accepted yet is not a PI delay. It is a liability delay.
  • A payment that was made, but you disagree with the rate, is a decision — appeal it. Do not dress it up as delay.
The pattern that hurts veterans most is: flag for expedition, no action, veteran escalates, DVA defends the process instead of deciding the claim. Break that loop by forcing a decision date into writing.
