I want compensation for how the claim was handled

Build a CDDA pack: timeline, RMG 409 map, causation, quantum. Do not skip the underlying claim.

When: The administration — not just the decision — has cost you money or health. · Several sessions; do not try to write it in one night

Step 1Finish or parallel-path the statutory claimCDDA does not replace PI, incapacity, or ASP. Get those decided.
Step 2FOI the file if you do not have the notesYou cannot map defective administration from memory.
Step 3Build the timeline and RMG 409 tableEach row: date, event, which RMG 409 category, document.
Step 4Cost the lossInvoices, extra treatment, a defined period of lost earnings, interest if you can show it. Attach workings.
Step 5Lodge with DVA and keep the Ombudsman in reserve for the CDDA handling itselfUse the CDDA letter. Send it once, complete.

Watch-outs

Discretionary. Defect plus detriment still may not pay.
A later PI lump is not an answer to a hardship delay — say that in the application.
Do not claim a round $100,000 with no line items.
